Shenzhen Details Residence Permit Administration for Foreign High-End Talent in Qianhai

Sept. 9 – Shenzhen released the “Tentative Measures on Residence Permit Administration for High-End Foreign Talents in Qianhai (shenfubanhan [2013] No.98, hereinafter referred to as the ‘Measures’)” on August 20, which roll out detailed measures for foreign high-end talents in Qianhai to apply for residence permits in the country. Detailed information can be found below.

Applicable Scope

The Measures apply to the following individuals:

High-end talents who have obtained recognition according to the “Regulations on Identifying Overseas High-End Talent and Professionals in Short Supply in Qianhai (hereinafter referred to as the ‘Regulations’)” and the “Implementing Rules for the Regulations on Identifying Overseas High-End Talent and Professionals in Short Supply in Qianhai (hereinafter referred to as the ‘Rules’),” and their foreign spouses and children under 18 years old.
Returned high-end Chinese talents who have obtained recognition according to the Regulation and Rules, and their foreign spouses and children under 18 years old.

Residence Permit

Qualified foreign high-end talents may be issued one of the following residence permits:

A foreign residence permit which lasts for two to five years; or
A permanent residence permit.

Application Procedures and Materials

The employers of foreign high-end talents shall apply with Qianhai Administration Bureau for long-term stay in China on behalf of such qualifying individuals. The Qianhai Administration Bureau will then complete the relevant name lists and the “Registration Form for High-End Foreign Experts” or the “Registration Form for High-End Returned Overseas Students,” and submit these forms together with the relevant supporting documents to the Guangdong Human Resource and Public Security Bureau for approval.

Foreign high-end talents shall submit the following materials with their application of long-term stay in China:

“Application Form for Visas and Residence Permits” along with a two-inch bareheaded personal photo attached;
Receipt of digital photo collection for visas;
Passport or other international travelling certificates;
Copies of the latest entry visa or residence certificates;
“Temporary Accommodation Registration Form of Overseas Personnel” issued by the local police station or hotels;
Valid health certificate issued by the quarantine and inspection authority;
Relevant kinship certificate, such as marriage certificate or birth certificate; and
Other certificates required by the public security bureau.

Permanent Residence

The employers of foreign high-end talents shall apply with Qianhai Administration Bureau for permanent residence on behalf of such talents. The Qianhai Administration Bureau will then complete the relevant name list and the “Registration Form for High-End Foreign Experts” or the “Registration Form for High-End Returned Overseas Students” and submit these forms together with the relevant supporting documents to the relevant human resource and public security bureau for approval.

Foreign high-end talents shall submit the following materials for application of permanent residence in China:

“Application Form for Visas and Residence Permits” along with a two-inch bareheaded personal photo attached;
A two-inch bareheaded photo with blue or white background, along with the electronic form of the photo stored on a compact disk;
Copies of passport and visas;
“Temporary Accommodation Registration Form of Overseas Personnel” issued by the local police station or hotels;
Valid health certificate issued by the quarantine and inspection authority;
Relevant kinship certificate, such as marriage certificate or birth certificate; and
Other certificates required by the public security bureau.

The Measures came into effect on September 1, 2013, and will be implemented for two years on a trial basis.
