How does software copyright in China work?
China’s Copyright Law and the Regulations on the Protection of Computer Software (2013) guarantee formality-free copyright of software upon creation. This applies to the software of any company domiciled in China, regardless of whether it has been published, as well as to the software of foreign or stateless individuals, if it was first published in China.

However, this basic guarantee does not evidence copyright ownership. To evidence copyright ownership, companies must apply for a Software Copyright Certificate (SCC), issued by the Copyright Protection Center of China (CPCC). Copyright registrations granted in another country are not recognised in China.
Why register copyright for your software in China?

Without registration, a company does not have any official proof of the automatic copyright. An SCC is required to evidence copyright ownership in a Chinese court, and e-commerce platforms may also require one to issue cease and desist letters or take-down notices against counterfeit products. This means protecting the copyright without registration can become very difficult in the event of infringement, litigation, or other forms of IP enforcement.
App store publication
Both Android and iOS app stores in China require an SCC for an application to be published. This is because the stores require proof of copyright ownership to verify that the applicant is the legitimate owner of the software before it is made available to consumers, reducing the risk of counterfeit or unauthorised apps appearing on their platforms.
Commercial ICP licensing
While not required for basic ICP filing of a website, an SCC may be required for a commercial ICP license. If you are planning to sell or provide software for commercial purposes, you may be required to prove ownership of these products, which typically requires an SCC for the products in question.
Apple Search Ads
Industry practitioners have reported that an SCC has become a requirement for running Apple Search Ads campaigns in mainland China as part of its ad content qualification review process, despite not being formally listed among Apple’s initial documentation requirements. Companies planning to advertise their software in the Chinese App Store should therefore plan for this requirement.
Who should consider registering their copyright?
Companies are strongly advised to register the copyright for their software if they are in any of the following circumstances:
- Making software publicly available in China – any software provided to external users is at risk of infringement and should generally be registered to ensure ownership can be proven and enforced
- Publishing apps on Chinese app stores
- Running Apple Search Ads to advertise an app or other piece of software
- Pursuing a commercial ICP license to sell or provide software commercially in China
- Licensing or distributing through a Chinese partner, to strengthen the enforceability of licensing agreements and contracts
- Raising investment or pursuing M&A in China – especially for any non-public proprietary software that can help improve a company’s valuation
- Entering a joint venture with a local developer – registration can help clarify and protect ownership when code is created or modified locally
When is copyright registration not the right choice?
Getting an SCC can be a high extra cost and administrative burden for small companies in particular. The application requires the provision of a range of documents to evidence ownership and originality of the software, such as source code samples, a user manual, and proof of business registration. Companies often outsource the registration to a third-party agency entirely, which incurs additional agency fees.

An SCC is also required for each piece of software, meaning costs can quickly build if a company owns multiple proprietary pieces of software, and changes to the software may trigger the need for a new SCC.
Copyright registration may therefore not be the right choice for your company if any of the following situations:
- Software use is for internal use only: If a proprietary piece of software is only intended for internal use, such as an internal inventory management tool or employee scheduling system, then there are few risks of infringement or commercial drivers for registration.
- There is no intent to publish or commercialise in China: If the software is developed for markets outside China, or is still in early prototype or R&D stages with no near-term plan for Chinese distribution, companies can defer registration until the time it becomes commercially necessary.
- The software is already protected by other IP mechanisms: If the company’s software constitutes patentable technology or a trade secret that is best protected through confidentiality and access controls, then registration may either not be necessary or desirable, since a copyright registration requires source code disclosure to the CPCC.
